Terms and Conditions

By booking tickets, you agree to the terms & conditions and privacy policies set by:

Irvington Theater

All sales are final. There are NO REFUNDS and NO EXCHANGES unless a show is cancelled. Please send a friend in your place if you cannot use your tickets.

 

I acknowledge the Village of Irvington and its affiliates (collectively, “Irvington Theater”) has granted me a revocable license to the applicable event, whether hosted in-person or virtually (the “Event”). I acknowledge that I will follow all instructions and/guidelines issued by Irvington Theater at all times during the Event.  Irvington Theater reserves the right to revoke the license of any person whose conduct is deemed to be disorderly, who uses abusive language, fails to comply with these terms, any physical or information security policies or any terms and/or rules imposed by the Event premises or by Irvington Theater, as applicable.

 

Under certain facility rules, certain items may not be brought into the Event premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles and containers.  Irvington Theater reserves the right to confiscate any item which in the opinion of the Irvington Theater may cause danger or disruption, be a health and safety risk, not be suitable to be taken into the Event or is one of the items not permitted in the Event premises as detailed in these Terms and Conditions. 

 

I acknowledge and understand that any content provided in an Event is for general informational or educational purposes only and is provided on an AS IS basis. Irvington Theater makes no representations or warranties, of any kind whatsoever, express or implied, as to the completeness, accuracy, usefulness or timeliness of information presented and Irvington Theater shall have no liability for any error or omissions. Under no circumstances should any content provided herein be construed as professional, investment, legal, tax or accounting advice by Irvington Theater and the statements within the content should not be used without the advice of a third party professional with expertise in the relevant field. The views, information, or opinions expressed during the Event are solely those of the individuals involved and do not necessarily represent those of Irvington Theater or of its employees. Irvington Theater assumes no responsibility or liability for any errors or omissions in the content provided in an Event.

 

I give my irrevocable consent and grant Irvington Theater and its affiliates the right to utilize my name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event (regardless of whether before, during, or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, including without limitation for commercial or promotional purposes, without further review or authorization from, or compensation to, me or anyone acting on my behalf. 

 

No refund or other remedy will be provided under any circumstances, including, without limitation, if the holder is ejected or refused entry due to disorderly conduct or failure to comply with these terms, any security policies or any terms and/or rules imposed by the Event premises or by Irvington Theater, as applicable, and I will not be entitled to any damages, including, but not limited to consequential, incidental or exemplary damages.  All ticket purchases are non-transferrable. If I do not receive a confirmation (in the form of a confirmation page or email) after submitting payment information, or if I experience an error message or service interruption after submitting payment information, I acknowledge my responsibility to confirm with the event organizer whether or not my order has been placed. I acknowledge only I may be aware of any problems that may occur during the purchase process.  I acknowledge Covered Parties will not be responsible for losses (monetary or otherwise) if I assume that an order was not placed because I failed to receive confirmation.

 

Except in the case of gross negligence by Irvington Theater, I agree that Irvington Theater’s liability for loss or damage to me shall be limited to the price I paid for (a) my ticket, or (b) the services I received at the Event.  I ACKNOWLEDGE I WILL NOT BE ENTITLED TO CONSEQUENTIAL, INCIDENTAL, OR EXEMPLARY DAMAGES OF ANY KIND.

 

I acknowledge that I am above the age of majority of the country that the Event is being held and agree to all these Terms and Conditions prior to entering the Event.

 

Irvington Theater may revise these terms and conditions, in our sole discretion, at any time and without prior notice to you, by updating this posted version of these Terms and Conditions.  You should review this website for changes to these Terms and Conditions. Any changes are effective upon posting to this website. If you disagree with any changes, your sole and exclusive remedy is to terminate your relationship with Irvington Theater.  Your continued use after notice of a change has been posted will constitute your acceptance of those changes. 

 

These terms and conditions shall be governed by New York law, without regard to conflicts of laws provisions. By participating in this Event, you agree that any dispute or litigation arising from or relating to this Event shall be determined by any court of competent jurisdiction.

 

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

 

·       Email address

·       First name and last name

·       Phone number

·       Address, State, Province, ZIP/Postal code, City


Irvington Theater may use Personal Data for the following purposes:

 

To manage Your Account: to manage Your registration as an attendee of an event affiliated with Irvington Theater.

 

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Irvington Theater or one of its affiliates.

 

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication related to the event to which you are a ticket holder.

 

To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

 

To manage Your requests: To attend and manage Your requests to Us.

 

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

 

For other purposes: We may use Your information for other purposes, such as data analysis, identifying trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

 

We may share Your personal information in the following situations:

 

·       With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

 

·       For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

 

·       With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Irvington Theater’s parent organization and the named producer of the event.

 

·       With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.

 

·       With Your consent: We may disclose Your personal information for any other purpose with Your consent.

 

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

 

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

 

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

Irvington Theater does not knowingly collect personally identifiable information from anyone under the age of 13, unless required by applicable law or emergency directive. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact us. If Irvington Theater become aware that Personal Data has been collected from anyone under the age of 13 without verification of parental consent, steps will be taken to remove that information from our system.
