Article 1. General
 1. These general terms and conditions apply to relationships between DGTL B.V., a subsidiary/sister company of DGTL B.V. or a partnership between it and third parties, all jointly referred to hereinafter as: ‘DGTL’ on the one hand, and on the other hand to a person (hereinafter referred to as the ‘Visitor’) wishing to attend an event organized by DGTL(hereinafter referred to as the 'Event') and has purchased an admission ticket for this purpose on which DGTL has declared these terms and conditions applicable, which applicability Visitor has explicitly accepted by the purchase of an admission ticket. 2. These general terms and conditions also apply to admission tickets acquired from third parties (e.g. agents, websites of authorized parties and suchlike) that have been engaged or designated by DGTL for that purpose. DGTL will publish the names of the parties designated in this respect on its website www.apenkooi.com and/or on or via the Event's website. 3. In these general terms and conditions, Event will be taken to mean all dance and other festivities/festivals or other events organized by DGTL in the broadest sense of the word. 4. In these general terms and conditions, the site where the Event is held means the actual site of the Event as well as all grounds, areas, fields etc. around it that comprise the complex within which the Event takes place. 5. If any of the provisions of these general terms and conditions are partially or wholly null and void or are voided at any time, the other provisions of these general terms and conditions will retain their full force and effect. DGTL and the other party will then consult with a view to agreeing new provisions to replace the void or voided provisions. In doing so, the purpose and meaning of the original provisions will be taken into account as much as possible. 6. If there is any ambiguity regarding the interpretation of any of the provisions of these general terms and conditions, such provision must be interpreted 'in the spirit' of these general terms and conditions. 7. If a situation arises between the parties that is not regulated under these general terms and conditions, such situation must be assessed in the spirit of these general terms and conditions. 8. If DGTL does not always require strict compliance with these terms and conditions this will not mean that the provisions thereof are not applicable or that DGTL loses the right to require strict compliance with the provisions of these terms and conditions in other cases. Article 2 Contractual formation/admission tickets 1. The agreement between DGTL and the Visitor regarding the attendance of the Event is formed when the Visitor purchases or orders an admission ticket for the Event from DGTL or from a third party engaged by DGTL. 2. These general terms and conditions and the house rules (the 'House Rules') published on the website of the relevant Event or DGTL's website apply to this agreement to purchase an admission ticket and to the attendance of the Event. The agreement between DGTL and the Visitor regarding the attendance of the Event cannot be terminated or amended by the Visitor. 3. DGTL is always entitled to refuse orders for admission tickets. 4. An admission ticket can be in the form of a document issued by or on behalf of DGTL or a barcode issued by DGTL. The barcode is a unique code. 5. The admission tickets are and remain the property of DGTL. The admission ticket is issued once and grants admission to one person. The original admission ticket gives the Visitor the right to attend the Event. The loss, damage, theft or misuse of the admission ticket is for the account and risk of the Visitor from the time that the admission ticket is made available to the Visitor. 6. The validity of the admission ticket is guaranteed only if purchased from third parties engaged by DGTL or from DGTL itself. The burden of proof in this respect lies with the Visitor. 7. The admission ticket in the form of a barcode is issued to the Visitor via electronic communication (e-mail). If the Visitor chooses to receive the admission ticket via electronic communication, the Visitor must ensure that this admission ticket can be issued via the correct electronic communication and that this can be done in a secure manner. DGTL cannot guarantee the confidentiality of the admission ticket issued nor can it guarantee its receipt. 8. DGTL reserves the right to set a maximum on the number of admission tickets to be ordered and the Visitor is obliged to comply with the maximum set by DGTL. Article 3 Payment 1. Besides payment at once for a ticket, DGTL provides the possibility to pay for festival tickets in three (3) monthly instalments to spread the costs. 2. If the Visitor chooses for monthly instalments, the first payment will be charged and paid by IDEAL or credit card, followed by two monthly payments by direct debit (‘automatische incasso’). The terms and amounts of payment will be defined by DGTL. 3. The total price of the instalment ticket will be the same as a full price festival ticket with a surplus of EUR 1,50 for administration costs per monthly instalment. 4. Any Visitor who does not fulfil the total ticket value increased with administration costs within 10 days after the first reminder to pay or opt out of remaining payments, will lose his/her deposit. There are no refunds on payments already made. Article 4 Prohibition on resale, etc. 1. The Visitor is obliged to reserve the admission ticket for an Event for his/her own use and consequently Visitor may not resell it to third parties in any manner whatsoever, nor may Visitor offer it for sale or offer or supply it in the context of commercial purposes failing which Visitor will be liable for an immediately payable penalty of EUR 5000 for each breach and EUR 1000 for each day that the breach continues as well as payment of the profits acquired. 2. Any admission ticket not directly acquired from or paid to DGTL and/or a third party engaged by it is invalid and does not entitle attendance of an Event. DGTL is entitled to refuse the Visitor admission to the Event if on inspection of the admission ticket DGTL suspects or knows that it is an invalid admission ticket. The burden of proof lies with the Visitor to demonstrate that the admission ticket is indeed valid (e.g. by submission of payment of proof to DGTL). 3. The Visitor who, gratuitously and not in the context of commercial purposes, has made his admission ticket available to third parties as referred to under 1 is obliged to also impose the obligations to which he/she as Visitor is subject as referred to in these general terms and conditions and the House Rules, on the person to whom he/she has made the admission ticket available and Visitor guarantees DGTL that this person or persons will comply with these obligations. 4. If the Visitor fails to comply with his/her obligations as referred to in the foregoing provisions of this article or cannot vouch for compliance thereof, Visitor owes DGTL an immediately payable penalty of EUR 5000 for each breach and EUR 1000 for each day that the breach continued or continues without prejudice to DGTL's right to claim compliance and/or compensation of the loss suffered or to be suffered. Article 5 Visitor's other obligations 1. The Visitor is obliged to comply with the House Rules while attending the Event. 2. The Visitor is obliged, if so requested, to cooperate with a body search when attending the Event. 3. The Visitor must be in possession of a valid and undamaged admission ticket both before the start of and during the Event and for as long as he is on the site where the Event is being held. The Visitor must, when requested, always present his admission ticket for inspection by DGTL's employees or employees of third parties engaged by DGTL, such as attendants and security guards. 4. Both during the attendance of the Event and when ordering/purchasing the admission ticket, the Visitor is obliged to provide DGTL with identification on request to allow DGTL, among other things, to satisfy its legal obligations within the context of events, which include the obligation not to serve alcohol to persons younger than 18 years of age. 5. Photo, film and other recording equipment may not be taken on to the site where the Event takes place on pain of confiscation of the aforementioned equipment for the duration of the Event. 6. Glassware, plastic bottles, cans, fireworks, firearms, weapons and/or other dangerous objects, banned substances, and/or alcoholic drinks may not be taken on to the site where the Event takes place on pain of confiscation of these items. 7. Recording of the Event in whatever form, including photographing, filming and any other type of sound and/or image recording is forbidden, as is reprinting or reproduction of parts of the programme, posters or other printed matter. All such recordings will be confiscated and destroyed outright. 8. If, after entering the site where the Event is to take place, the Visitor leaves the site, the admission ticket loses its validity. 9. The Visitor is obliged to comply with the instructions or directions given by DGTL, or the third parties engaged by it, the proprietors of the site where the Event takes place, the attendants, the fire brigade and other authorized persons. 10. Without the prior written consent of DGTL, the Visitor and all other persons may not offer or sell merchandise at the Event. 11. Without the prior written consent of DGTL, the Visitor and all other persons may not distribute flyers at or in the vicinity of the Event, neither may they put up posters or banners nor carry out any other type of promotional activities. 12. The Visitor is obliged to comply with the rules governing public order (e.g. no urinating in public, no public drunkenness, no aggressive behaviour and suchlike), failure to comply with these rules will result in DGTL refusing the Visitor (further) admission to the Event without prejudice to DGTL's right to recover loss arising as a result hereof from the Visitor. 13. For situations not regulated under these general terms and conditions, DGTL will decide on possible measures to be taken. Any decision taken by DGTL in this respect is binding. Article 6 DGTL's rights 1. If the Visitor violates any of the provisions referred to in these general terms and conditions or the House Rules, DGTL is entitled to invalidate/cancel the admission ticket or refuse the Visitor (further) admission to the Event without the Visitor being entitled to reimbursement of the amount (including services charges) paid to DGTL directly or via an (advance) sales address. The holders of invalidated admission tickets are not entitled to reimbursement or any other form of compensation. 2. DGTL reserves the right to refuse the Visitor (further) admission to the Event or the site where the Event takes place if DGTL deems this reasonably necessary to maintain the peace and order during the Event. 3. If it is plausible that the admission ticket has been forged, DGTL is entitled to refuse the holder of this admission ticket the (further) admission to the Event without the holder of this forged admission ticket being entitled to claim any compensation for loss suffered as a result hereof. 4. Refreshment tokens purchased by Visitor during the Event in whatever form, may only be presented in exchange for products offered at the Event such as drinks or food. The refreshment tokens never give the right to reimbursement of an amount. Therefore, refreshment vouchers purchased by the Visitor at an Event do not entitle the Visitor to reimbursement or repayment of the purchase price during or after the Event. 5. An announcement for a line-up of performers, location and suchlike is without obligation and could be subject to changes. DGTL is entitled to implement changes, which never entitle the Visitor to compensation. Naturally attempts will always be made to implement changes that are in line with the nature of the Event. 6. The performer and DGTL are entitled to make or have an image or sound recording made of the Event and to use these images for their own promotional purposes or for those of their partners or sponsors. Visitors appearing in the recordings make not claim any right to any compensation or portrait right. 7. DGTL reserves the rights and powers vested in it pursuant to the Copyright Act and other intellectual property laws and regulations. Article 7 Force Majeure 1. In the event of force majeure in the broadest sense of the word, including in this respect, illness or cancellation by the performer(s), instructions from the authorities, strikes, fire, bad weather conditions, epidemics etc., DGTL is entitled to move the Event to a later date or to cancel the Event entirely. 2. If the Event, as a result of or in connection with force majeure, is cancelled by DGTL before it has begun, DGTL is only obliged to refund a reasonable amount to an Visitor in possession of an original proof of payment acquired from an DGTL-approved outlet for an admission ticket for an Event, which amount can never exceed the price stated on both the proof of payment and the admission ticket. 3. If an Event, as a result of or in connection with force majeure, must be cancelled after it has begun, DGTL will grant the Visitor a discount of 25% on another subsequent Event organized by DGTL. 4. If the Event, as a result of or in connection with force majeure, is moved to another date by DGTL, the admission ticket remains valid for the new date on which the Event will take place. If this is the case, this will be published on DGTL's website. In such case the Visitor may not claim (substitute) admission to another Event organized by DGTL as referred to under 4. 5. Any claims made with respect to that set out in this article must be made in writing and submitted to DGTL within seven (7) days after the original date of the Event (and must include the original admission ticket and the original proof of payment). Article 8 Liability DGTL 1. DGTL is never liable for loss suffered by the Visitor through the attendance of the Event except in the case of wilful act or gross negligence on the part of DGTL. In such case, DGTL's liability is limited to direct loss suffered by the Visitor against which DGTL is insured and which will actually be compensated by the insurer. Not eligible for compensation are:a)     Consequential loss;b)     Intangible loss;c)     Loss caused by wilful act or deliberate recklessness on the part of third parties and assistants engaged by DGTL. 1. Claims against DGTL must be submitted to DGTL in writing within seven (7) days after the Visitor suffered the loss (and must include the original admission ticket and the original proof of payment) and will be dealt will as soon as possible. 2. The Visitor enters the site where the Event takes place and attends the Event at his own expense and risk, in the sense that DGTL accepts no liability whatsoever for loss arising as a result of aforementioned entry or attendance such as e.g. hearing, visual and other physical impairments. 3. DGTL will do its utmost to ensure that the programme is performed in accordance the timetable announced. However, it is not liable for any deviations therefrom and for the (possible) loss that Visitor or third parties could suffer as a result thereof. Start and end times as stated on admission tickets are subject to the proviso that these can change / overrun. The Visitor is obliged to check DGTL's website regularly to ascertain whether or not the starting time has changed. 4. DGTL is furthermore not liable for the content of the Event's programme or how it is performed, which expressly includes the length of the programme. Nor is DGTL liable for changes in the Event's programme. 5. In addition, DGTL is not liable for loss suffered by the Visitor arising as a result of loss or damage of goods or the admission ticket. Article 9 Applicable law and disputes 1. Dutch law applies exclusively to all legal relationships to which DGTL is a party, also if an agreement is partly or wholly executed abroad and if the party in the legal relationship resides abroad. 2. Parties will appeal to the court only after they have done their utmost to settle the dispute by agreement.

Articulo 1. General

Estos términos y condiciones aplicadas entre DGTL BV, subsidiaria / filial de Apenkooi Events BV o una alianza entre sus tres fiestas, hereinafter all together, "DGTL 'and, secondly, a person an event from DGTL (hereinafter the "Event") wishes to visit and to this end has bought a ticket (the 'Visitor') which DGTL these conditions has stated and visitor accepts these conditions explicitly, by buying a ticket.

Qué fiestas se han dado a conocer por DGTL a través de su página web www.dgtl.nl o a través de la página web del evento. 

En el evento estos términos significan todo lo organizado por DGTL fiestas (baile) / festivales o otros eventos en el sentido más amplio de la palabra. 

El lugar donde se lleva a cabo el evento esta sujeto bajo estos términos que significan que el sitio real del evento, las áreas, espacios, campos etc.. que encontramos a su alrededor, son parte del complejo donde se celebrará el evento.

Si uno o más disposiciones de las que se anuncian en estos términos se ve en cualquier momento, total o parcialmente inválida o nula, el resto de los términos y condiciones se aplicarán plenamente. DGTL entablará entonces un diálogo con la otra parte para así desarrollar nuevas reglas que sustituirán a las disposiciones inválidas, tan similar como sea posible al propositito e intenciones de las disposiciones originales que se observan.

Si existe incertidumbre en cuanto a la interpretación de una o más disposiciones de estos términos y condiciones, entonces la explicación debe tener lugar en función de estos términos y condiciones.

Si surge un conflicto entre las partes que no está cubierto por las presentes condiciones generales, esta situación debe ser evaluada en el función de estos términos y condiciones.

Que DGTL no requiera el estricto cumplimiento de estas condiciones, esto no quiere decir que sus disposiciones no se apliquen ya que sino DGTL perdería el derecho a exigir de otro modo el estricto cumplimiento de las disposiciones de estos términos y condiciones.

Artículo 2 Conclusiones de los acuerdos / las entradas

El acuerdo sobre la visita del evento entre DGTL y el visitante se produce cuando el visitante ordena la compra de una entrada para el evento de DGTL o la compra es ordenada a un tercero contratado por DGTL 

Este acuerdo para comprar una entrada y visitar el evento bajo estas condiciones generales y reglas de la casa se ha publicado en la web del evento relevante o en la propia web de DGTL ( The “House Rules). El acuerdo que se lleva a cabo sobre la visita entre DGTL y el visitante, no puede ser disuelto ni alterado por el visitante.

DGTL siempre se reserva el derecho de rechazar pedidos de entradas. 

El ticket de entrada puede consistir en un documento emitido pro o en nombre de DGTL o en un código de barras suministrado por o en nombre de DGTL. El código de barras es un código único.

Los tickets de entrada son y seguirán siendo propiedad de DGTL. Las entradas sólo se emitirán una vez y para una sola persona. La entrada original le da al visitante el derecho a acceder al evento. La pérdida, el daño, robo o abuso de la entrada es responsabilidad del visitante desde que se pone a su disposición.

Sólo es válida la compra a un tercero contratado por DGTL o al propio DGTL. La veracidad de la entrada recae sobre el visitante. 

Sólo la compra de un tercero contratado por DGTL o DGTL garantiza la validez del billete. La carga de la prueba recae en el visitante. 

La entrada consiste en un código de barras que se recibe vía correo electrónico y que es proporcionada al visitante. Si el visitante ha elegido recibir la entrada vía online se ha de asegurar que la entrada finalmente se le suministre de manera correcta y de forma segura. DGTL puede garantizar la confidencialidad de la entrada subministrada pero no su recepción.

DGTL se reserva el derecho de establecer un número máximo de pedidos de entradas y el visitante está obligada a adherirse al máximo establecido por DGTL. 

Articulo 3 Prohibiciones en la compra, etc.

El visitante está obligado a utilizar la entrada del evento para si mismo y en ningún caso podrá venderla a un tercero, ni ofrecer un descuento o ofrecer a partir de esta fines comerciales. El incumplimiento de esta prohibición estará penado bajo daños y perjuicios reclamados de manera directa, 5000€ por violación y 1000€ por día que se haya violado o se hayan obtenido provechos. 

La entrada que no se haya obtenido directamente por o pagada para DGTL y/o terceros relacionados con este será invalido y no permitirá el acceso al evento. DGTL podrá denegar el acceso a un visitante si sospecha que quiere acceder a éste con una entrada inválida. La forma de probar que se trata de un billete válido se encuentra en manos del visitante ( por ejemplo, con la presentación de un recibo enviado por DGTL)

Si el visitante no cumple con las obligaciones que se indican en los párrafos anteriores de éste articulo deberá asumir una multa de 5000 euros por violación a DGTL y 1000 por cada día que la violación ha continuado y continua sin prejuicio del derecho de DGTL. Además de pedir la reparación del prejuicio sufrido para así recuperar los daños.

Articulo 4 Otros requisitos para los Visitantes

El visitante esta obligado a cumplir durante el evento el reglamento impuesto.

Se requiere al visitante, si se le solicita, la cooperación en el registro corporal para acceder al evento.

El visitante debe tener en posesión una entrada válida e intacta antes y durante el tiempo que esté en el lugar donde se realiza el evento. Se requiere que en cualquier momento éste pueda mostrar su entrada a cualquier empleado de DGTL, empleados contratados por terceros o agentes del orden y guardias de seguridad.

El visitante está obligado a cumplir el primer requisito ya sea durante el evento o en el momento de ordenar la compra del billete, para identificarse ha de cumplir, entre otras cosas, con las obligaciones legales que están establecidas alrededor del evento, incluyendo la obligación de no proporcionar alcohol a las personas menores de 18 años.

Está prohibido fotografiar, hacer películas o utilizar otros equipos de grabación y/o llevaros al lugar del evento. Esto estará regulado bajo pena de confiscación de dicho equipo durante el evento.

Se prohíbe material de vidrio, botellas de plástico, latas, fuegos artificiales, armas y/ u objetos peligrosos, drogas ilegales y/o alcohol que se lleva al lugar del evento. Esto estará pagado bajo confiscación de estos asuntos.

Se prohíbe registrar el evento ya sea fotografiando, filmando o haciendo un audio y / o visuales. De la misma forma también se prohíbe la adquisición del programa (folleto), carteles y otros materiales impresos. Todas estas grabaciones serán confiscados y destruidas sin condiciones.

Si el visitante después de entrar en el lugar donde se celebra el evento, decide abandonar el lugar y salir del recinto su billete pierde la validez.

El visitante está obligado a cumplir con las regulaciones y / o direcciones de DGTL, de terceras partes que intervengan, de los operadores del lugar donde se celebra el evento, del personal de seguridad, bomberos y otras personas autorizadas.

El Visitante y/o cualquiera tendrá prohibida, sin el consentimiento previo por escrito de DGTL, la venta de la mercancía de los eventos.

El Visitante y todo aquel que lleva a cabo distribución de folletos, carteles y / o banderolas para colgar o realizar otro tipo de actividades de promoción no podrá llevarlo a cabo sin el consentimiento previo por escrito de DGTL.

El visitante está obligado a cumplir con las normas aplicables a la política pública (por ejemplo. No orinar, no ir bebido en exceso, no llevar a cabo ningún comportamiento agresivo, etc.), por violaciones de DGTL se podrá denegar el acceso al evento, sin derecho perjuicio de DGTL para recuperar los daños causados ​​por el visitante.

En las situaciones en las que no se proporcionan estas condiciones, DGTL es el encargado de tomar las medidas precisas. La decisión de DGTL es la que finalmente cuenta. 

Artículo 5 Derechos de DGTL

En caso de violación por parte del visitante de ( alguna de ) las disposiciones mencionadas en estos términos y condiciones o de las “ normas de la casa” es DGTL el encargado de considerar como invalida la entrada del visitante y denegarle el acceso al evento sin derecho alguno del visitante de pedir un reclamo del dinero de su entrada ( incluyendo los gastos de servicio) DGTL, sea o no a través de una dirección de ( pre) venta. Los titulares de entradas no válidas no tienen derecho a devolución o compensación de otro modo.

DGTL siempre se reserva el derecho del Visitante para impedir el acceso de éste al evento o al lugar donde se celebra el evento si DGTL lo considera razonablemente necesario para el mantenimiento de la paz y el orden durante el evento.

Si se evidencia una falsificación del billete es DGTL el que tiene el derecho sobre el titular de este billete y puede denegarle el acceso al evento sin que el titular de este billete falso puede reclamar cualquier daño que sufra.

Los diferentes artistas y DGTL tienen el audio del evento y/o sonido y pueden utilizar estas imágenes con fines promocionales, por ellos mismos o para sus socios o patrocinadores. Los visitantes que aparecen en las grabaciones no pueden reclamar ninguna indemnización o en derechos de imagen.

DGTL retiene todos los derechos y facultades bajo su derecho de autor y otras leyes y reglamentos intelectuales.

Articulo 6 Fuerza mayor

En caso de fuerza mayor en el sentido más amplio del contexto, es decir, incluyendo la enfermedad y / o cancelación por parte del artista (s), instrucciones del gobierno, huelgas, fuego, el mal tiempo, epidemias, etc. DGTL tiene derecho a cambiar el evento a una fecha posterior o directamente cancelar el evento. 

Si el evento se cancela como resultado de o en relación a una de las fuerzas mayores especificadas anteriormente y antes de que haya comenzado, DGTL reembolsara el precio de la entrada a todos aquellos visitantes que la hayan adquirido. 

Si un evento ha sido cancelado debido a una fuerza mayor después de que haya comenzado, DGTL le dará al visitante un descuento del 25% sobre una entrada a otro evento organizado por DGTL.

Si el evento como resultado de o en relación a una fuerza mayor fuera trasladado a otra fecha, el billete sería válido para la nueva fecha establecida.

Si fuera este el caso se daría a conocer a través de la página web de DGTL. El visitante no puede reclamar en ese caso acceso ( recambio) para otro evento organizado por DGTL como se ha mencionado en el 4.

Artículo 7 Responsabilidad DGTL

DGTL no se hace responsable de los daños causados ​​por el visitante durante el evento a menos que exista negligencia por parte de DGTL. En ese caso DGTL tendrá que asumir una responsabilidad limitada por los daños directos sufridos al visitante. Estas responsabilidades serán asumidas ya que DGTL está asegurado y estarán cubiertas por el asegurador. No es elegible para el reembolso:

DGTL se esforzará para presentar el programa de acuerdo con el calendario establecido que será implementado. Sin embargo, no se hace responsable de los cambios en el mismo y de los posibles daños y/o inconvenientes que esto podría suponer para el visitante y / o de terceros. El inicio y terminación que se indica en las entradas están sujetos a cambios y cancelaciones. El visitante está obligado a entrar en la web de DGTL para comprobar todos los datos que hayan podido ser modificados, como por ejemplo la hora de inicio. 

DGTL no se hace responsable del contenido y el método de realización del programa del evento, incluyendo expresamente la duración del programa. DGTL no se hace responsable de los cambios en el programa del evento.

DGTL no es responsable de los daños por parte del visitante derivados en la pérdida o de bienes o de la entrada.

Artículo 8 Ley aplicable y disputas

Sobre las relaciones con todos los DGTL legal de un partido, sólo el derecho holandés, también si un contrato total o parcialmente en el extranjero o si dicha parte lo está no involucrado en la relación.

Sólo las partes acudirán a los tribunales sólo después de haber intentado resolver la disputa de común acuerdo.
