DEFECTED LONDON FSTVL 2019 - VIP

1.      TICKETS, ADMISSION AND CANCELLATION
1. Upon booking a ticket you are agreeing to these Terms and Conditions in relation to Defected London FSTVL 2019 (“the Event”).
2. The Organiser Defected London FSTVL Limited (Defected FSTVL) reserves the right to add to or amend these Terms from time to time.
Amendments will take effect when posted on the Defected website https://defected.com/events. Please check the FAQ’s section regularly for changes and to ensure you have up to date information as these are binding on you. If you purchase a ticket after any amendment to these Terms, you agree to be bound by
the updated version of these Terms.
3. Tickets are sold through our official ticket agents who act on behalf of Defected FSTVL. Full terms and conditions relating to the purchase of tickets through the ticket agents can be found on their websites.
4. Defected FSTVL reserves the right to refuse admission.
5. Only valid tickets will be accepted on presentation at the Event. Be careful not to purchase tickets from unofficial third party sources as it cannot be guaranteed that they are genuine and invalid or duplicate tickets will not be accepted.
6. Valid photographic ID must be shown when presenting your ticket.
7. All tickets are non-transferable.
8. Admission is at ticket holder’s own risk. Defected FSTVL will not be held liable for any loss, injuries or damages sustained at the Event including damage, theft or losses to property and motor vehicles, if the cause is due to the negligence of the Ticket Holder or the actions of other patrons or third parties or Force Majeure.
9. If the Event is cancelled, only the face value of the ticket will be refunded and not the booking fee.
10. Wristbands that are removed from the wrist, lost or have been tampered with will be deemed invalid and will not be replaced. If you do not have a valid wristband you will be refused admission to the site or may be removed from the site. Wristbands issued by Defected FSTVL remain the property of Defected FSTVL.
11. Last entry to this Event is 17:00.  There is no re-entry to this Event.

2.      AGE POLICY
1. This Event is for people aged 18 years and over only.
2. Identification will be required on entry and the Challenge 25 policy will be in operation.
Acceptable ID: full British photo driving licence, valid passport.

3.      SEARCH POLICY
1. For the safety of our customers and staff, security will be conducting stringent searches at the gate.
2. Anyone found to be carrying illicit items will have them confiscated and may be removed from the festival and handed over to the police where necessary.
3. Please do not attempt to bring any of the following items inside the festival:
o Fireworks, laser pens, or flares
o Alcohol, illicit drugs, or legal highs including nitrous oxides
o Animals (with the exception of guide dogs)
o Selfie sticks
o Umbrellas
o Glass, perfume or aftershave bottles, foundation bottles etc
o Cans
o Hi Vis waistcoats, jackets or vests

o Bicycles or scooters
o Chairs
o Food / Drink / Cool boxes / Picnic hampers
o Pens or Paint
o Unmanned Aerial Vehicles (aka Drones)
o Anything which could be considered an offensive weapon or could cause danger or nuisance
o Any form of seating other than wheelchairs

4.     GENERAL
1. The artist and performer line-up and all billed attractions are subject to change at any
time without notice.
2. Strictly no commercial activities or trading on site unless previously agreed by Defected FSTVL.
3. Defected FSTVL accepts no responsibility for good or services purchased from third party traders.
4. As a condition of sale, the ticket holder consents to being filmed, photographed and recorded for television, radio, webcast and other public broadcast and/or for any video/DVD or by onsite CCTV cameras and recordings for security purposes.
5. The tented arenas and other areas of the Event are designated No Smoking areas (this includes e cigarettes), this is in accordance with the Smoke Free Regulations. Failure to comply with these regulations and Event signage may result in ejection.
6. Warning: exposure to loud and excessive music may be damaging to your hearing.
7. Pyrotechnics, lasers, smoke machines, strobe lighting and other special effects may take place during some performances.

5.      NOTICE OF FILMING AND PHOTOGRAPHY
1. When you enter the Event, you enter an area where photography, audio, and video recording may occur.
2. By entering the Event premises, you consent to interview(s), photography, audio recording, video
recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts,
promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by
Defected FSTVL and its affiliates and representatives. Images, photos and/or videos may also be used to promote similar Defected FSTVL events in the future, highlight the Event.
3. You release Defected FSTVL, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings.
4. By entering the Event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged.
5. You also waive any right to inspect or approve any photo, video, or audio recording taken by Defected FSTVL or the person or entity designated to do so by Defected FSTVL.
6. You have been fully informed of your consent, waiver of liability, and release before entering the Event.

6.      PERSONAL FILMING AND PHOTOGRAPHY
1. Photographs or any other recordings of sound or images taken by you at the Event may be used for personal, private, non-commercial and non-promotional purposes only. Y ou shall not, except for personal, private, non-commercial and non-promotional purposes and in any event not for commercial gain, disseminate at any time, over the internet, radio, television and/or any other current and/or future form or type of media, any sound, image, description of the Event (in whole or in part) including (without limitation) any such content made, recorded or captured in still or moving form by mobile phones or by any other form of wireless and/or portable device, and shall not assist any other person(s) in the conduct

of such activities. Any recording or transmitting equipment (including professional cameras), unauthorised photos, recordings, tapes, films or similar items may be confiscated and/or destroyed by us.

7.      MISCELLANEOUS

Any breach of any these conditions may result in the cancellation of your ticket, the refusal of admission to the Event, or your eviction from the Event, in each case without refund or compensation in addition to any other remedy that we may have. No failure or delay by us to exercise any right (in whole or in part) under these conditions shall constitute a waiver of that right, nor restrict any further exercise of that right.

In the event of any breach of any of these conditions by you, tickets and wristbands must, upon the request of Defected FSTVL staff, be delivered up to that member of staff. Such actions are without prejudice to other remedies which we may have.

These conditions constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these conditions which is not already set out in these conditions.

Any person (other than Defected FSTVL, the official ticketing agent or any Authorised Person) not party to these conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999.

These conditions will be governed by and interpreted in accordance with English law. Any dispute arising from or in connection with these conditions or your attendance at the Event will be submitted to the exclusive jurisdiction of the English courts. Notwithstanding the foregoing, we reserve the right to pursue any legal proceedings in a competent court in the defendant's domicile, which proceedings shall be governed by and interpreted in accordance with English law.
